§ 25-95. Stop order.

  • Any person who shall barricade a construction area and public right-of-way pursuant to the provisions of this division and violate any provision of this division shall be subject to a stop order issued by the director of engineering and transportation, any police officer, the building official or city engineer. If a stop order is issued, the person holding the permit and engaging in the work shall restore the work area to its proper condition as called for in the barricade plan, Barricade Manual and/or permit. Where the permittee does not restore the work area to its proper condition as called for in this section within two (2) hours after receipt of the stop order, the city shall proceed to do the work, and the cost thereof shall be charged to the permittee. The city shall have the right of action against any bond running from the holder of the permit to the city conditioned upon compliance with the ordinances of the city in the performance of the work, and the city attorney may prosecute an action against the permittee in a court of competent jurisdiction for the recovery of such expenses, damages or costs.
