§ 35.1.7. Conflict with Private Restrictions.

  • The provisions of the Denton Development Code are minimum requirements for the promotion of the public health, safety, comfort, convenience, and general welfare. It is not the intent of these regulations to interfere with, abrogate, or annul any private easement, covenant, restriction, or other agreement between private parties. When regulations imposed by the Denton Development Code require a greater restriction upon the use of a building or land, or upon the height of buildings, require larger open spaces, or otherwise impose greater restrictions than are imposed or required by other ordinances, rules, regulations, or by private easements, covenants, restrictions, or agreements, the provisions of the Denton Development Code shall control.
